RE:  Voting Requirements

Dear Mr. Cassam:

I am writing in follow up to our recent meeting.  At that meeting we discussed the various voting requirements for issues to be addressed by the Summit property owners.  Here is a brief synopsis of that meeting.

1)      Any changes to the By-Laws governing the Summit Owners’ Association, Inc. requires that a quorum, as established by the by-laws, be either physically present or have provided a proxy and that 2/3 of those present approve said change or amendment.

2)      Any changes to the covenants that affect the piers or boatslips must be approved by 2/3 of ALL of the property owners of “Boatslip” lots.

3)      Any other changes to the covenants must be approved by an agreement signed by a majority of ALL of the lot owners, not just a majority of those present at any association meeting.

Please let me know if the board/members require any further clarification or if you all have any other questions.

Sincerely,

Emma W. Morris

                                                                                                              Attorney at Law

Note: A Quorum is 1/3 of the eligible lot owners either present or by proxy.
