SUMMARY OF RESTRICTIONS – Article 8

Compiled as an unofficial aid to owners and contractors.  Not to be used as a substitute for Article 8 of The Summit Declaration of Covenants, Conditions, and Restrictions, dated November 27, 1995, and all subsequent Amendments.  Not to be considered as a legal document.

 

Section 1 – Land Use

·         Single family residential

·         2 ½ story maximum above ground level

·         No mobile home, modular home, shell home

·         Garages, outbuildings, fixed piers, and floating docks cannot be rented or leased for remuneration

·         No detached garage or outbuildings used as residence

·         No “time-share” or vacation ownership plans permitted

·         No boat or houseboat may be used as residence

 

Section 2 – Dwelling Size

·         2100 total square feet minimum

·         1800 square feet on the main floor minimum

·         Minimums refer to enclosed heated floor area

·         Unfinished basements, unheated porches, garages, carports, unheated storage areas, decks, or patios are excluded

 

Section 3 – Building Construction and Quality

·         New materials

·         $150,000.00 in 1995 dollars, exclusive of value of lot

·         Solid brick, stone, or stucco-covered block foundation

·         No vinyl siding, asbestos shingle siding, imitation brick, or stoneroll siding (Vinyl soffit and fascia are acceptable)

·         Hardy board siding is acceptable

·         No exposed concrete or cement blocks (split block)

·         Garage, outbuilding, and appurtenant structures must be architecturally compatible with dwelling

·         Roof pitch must be at least 6” in 12” with at least a 12” overhang

·         Roof must be covered with slate, cedar shakes, tile, or fiberglass shingles

·         Tin or rolled roofing is not permitted, except for copper

·         Construction must be completed within 1 year

 

Section 4 – Temporary Structures

·         No temporary residence or building can be erected

·         No structure or attachment made of metal, fiberglass, plastic, vinyl, or canvas – includes tent, barn, carport, garage, utility building, storage building

 

Section 5 – Building Setback Lines

·         No building, including stoops, porches, or decks,  within front or side street right-of-way

·         Setbacks:  (All measurements are made from foundation to property line, not right-of-way)

Front is 50 feet

Side is 10 feet

Side street is 35 feet

Back is 35 feet

Waterfront back is 50 feet from Full Pool – 800 feet above Mean Sea Level (Survey pins are placed at 804 feet above Mean Sea Level; therefore, property line is at 804 feet above Mean Sea Level.)

·         Piers, docks, and covered docks are exempt from setback rules, but are subject to permit regulations administered by Duke Power Lake Management

·         Gazebos are permitted within the 50 foot waterfront setback, but must be less than 150 square feet and not enclosed by walls

·         No masonry mailboxes or other structures within the right-of-way

Section 7 – Combination or Subdivision of Lots

·         No may be lot sub-divided and sold in part

·         Lots may be combined

·         Combined lots treated as one for purposes of Article 8

·         One pier zone for combined waterfront lots

·         Two boat slips for combined interior lots

·         Combined lots treated as two for voting and assessments

 

Section 8 – Utility Easements

·         Front is 10 feet

·         Rear is 10 feet, except waterfront lots

·         Side is 5 feet on each side

·         Drainage easements shown on plat maps

·         Owner is responsible to maintain easements and right-of-way at the street

·         No structure or other materials within the easements (Plantings destroyed by a utility using the easement are the owner’s loss and expense.)

 

Section 10 – Fences and Walls

·         Wood, brick, or stone

·         No chain link or other metal permitted

·         Metal mesh, 2” X 4”, may be used with split rail to contain animals or children within rear or side yards

·         6 foot high maximum

·         No more than 70% closed to view, except brick or stone

·         No fence or wall closer to the street than the front face of the house, except for split rail fencing no higher than 30” and no sideyard fence or wall on a corner lot closer to the street than the side face of the house with the same exception for split rail no higher than 30”

 

Section 11 – Signs  (See Amendment dated December 1, 1999)

·         No signs on any Common Area

·         Signs on lots:

Five square feet maximum

One professional quality For Sale sign permitted (and one at waterline)

One professional quality sign by builder to advertise the lot during construction and sales period

One professional quality security company sign – near house, 1 square foot

Temporary political signs permitted

 

Section 12 – Antennas, Satellite Dishes, or Discs

·         No freestanding radio or television transmission towers and antennas

·         No freestanding satellite dishes or discs exceeding 18 inches in diameter

·         Roof-mounted antennas may not extend more than 10 feet above the highest roof line ridge

·         Satellite dishes and discs should be installed in the least conspicuous location

 

Section 13 – Lot Maintenance and Trash Disposal

·         Owner must keep property clean, orderly, and in good repair, including maintenance of roadside

·         No clothes line may be erected

·         No storage of trash, rubbish, materials

Section 14 – Off-Street Parking and Off-Water Boat Storage

·         Concrete or asphalt driveway capable of parking 2 automobiles must be installed prior to occupancy

·         No truck or commercial vehicle in excess of one-ton load capacity

·         No vehicle under repair or trailer or wrecked or junked vehicle parked on any lot, in the Boat Storage Area, the Amenity Area, the Parking Area, or any Common Area

·         No boat and/or trailer on the Parking Area except when using the Boatslips and Piers

·         No trailer, motor home, recreational vehicle, camper, or boat may be used as a residence

·         No recreational vehicle may be parked on a lot for more than 24 hours, unless in the Boat Storage Area, or off the street and not within the front or side setbacks

·         Trucks, trailers, campers, boats, motor homes, and recreational vehicles must have a current license plate and be parked in an enclosed garage – if on the owner’s lot

·         Automobiles must have a current license plate and be parked in a garage, carport, or on a concrete or asphalt driveway

·         Trailers and boats on trailers are not permitted within the 50 foot waterside setback

·         No more than one boat and/or trailer per lot in the Boat Storage Area, subject to Boat Storage Procedures

 

Section 15 – Sewage Disposal

·         All dwellings must have an approved septic system

 

Section 16 – Nuisances

·         No noxious or offensive trade or activity allowed

·         No foul or obnoxious odors, or noise that disturbs peace and quiet 

·         No animals, livestock, or poultry may be raised, bred, or kept, except household pets not kept for commercial purposes

·         Household pets limited to three

 

Section 17 – Diligent Construction

·         Exterior construction must be completed within one year

·         No building materials stored within public or private roads, including right-of-way

·         Damage to streets, curbs, or Common Areas must be repaired

·         Dirt, mud, garbage, trash, and debris must be cleaned up by owner and/or contractor

·         Erosion control must be effected according to Exhibit D and maintained

·         One temporary driveway prior to start of construction – 50 feet of aggregate 6 inches deep

·         Silt control devices around the boundary of the disturbed earth

 

Section 18 – Community Water System; No Private Individual Wells

·         No well may be dug to provide domestic water

·         Well permitted for geo-thermal heating/cooling

 

Section 19 – Removal of Trees and Other Vegetation

·         Prior approval is recommended before the removal of any vegetative growth within 50 feet of the waterfront

·         Mature trees (6” diameter) within the 50’ waterfront setback may not be removed without written approval (Tree diameter is measured 12 inches above ground level.)

·         Dead or diseased trees may be removed

·         Poisonous plants may be removed

·         Underbrush may be selectively cleared

·         Understory may be thinned and trees may be “limbed“ to provide a better view

 

Section 20 – Marine Toilets

·         No water craft with a marine toilet and fixed or portable holding tank, or a through-hull or overboard discharge toilet is permitted – either at common boatslips or individual boatslips

Section 21 – Docks, Piers, and Boat Houses

·         One pier per waterfront lot within the pier zone

·         Docks and covered docks must be one-level and not enclosed

·         Maximum of 1000 square feet, including pier, ramp, and dock

·         No sundecks on top

·         Roof-covered docks are permitted, preferably in dark green which “blends” with the shoreline

·         Construction and placement of piers and docks are subject to the following:

·         Easements, restrictions, rules, and regulations of the Association

·         Laws, statutes, ordinances, and regulations of Federal, state, and local governmental bodies

·         Rules and regulations, privileges, and easements established by Duke Power Company

·         Permit issued by Duke Power Lake Management prior to construction or alterations

 

Section 22 – Boat Ramps

·         No boat ramps permitted

·         No boat launching from any lot

·         Small watercraft, such as canoes, dinghies, and jet skies may be launched, if launched without a ramp

 

Section 23 – Mailbox Structure Standards

·         Must conform to standards of Exhibit B included in Amendment to Covenants, recorded April 12, 2000

·         Wood post made of 6” X 6” X 6’ material – beveled and routed at top

·         Mailbox black in color, model T-2 Large (Approximately 20.3” D X 10.8” H X 8.5” W)

·         Paper holder beneath mailbox

·         Numerals 3-4” high mounted horizontally on both sides of paper holder 

·         MUST BE SILVER REFLECTIVE NUMBERS TO MEET REQUIREMENTS OF BOTH OCONEE COUNTY ORDINANCE and THE SUMMIT
